Overview
The Digital Millennium Copyright Act (DMCA) sets out a process for notifying online service providers about copyrighted material that has been used without permission. We follow that process under 17 U.S.C. § 512.
If you submit a complete and good-faith notice, we'll review it promptly and — if appropriate — remove or disable access to the material. If your material was removed and you believe that was a mistake, you can submit a counter-notification under § 512(g).
Filing a Takedown Notice.
For your notice to be effective under the DMCA, please include all of the following:
- Identify the copyrighted work. Tell us specifically what work you say is being infringed. If multiple works at a single online location are involved, you may provide a representative list rather than identifying each one individually.
- Identify the infringing material. Describe the material on our site that you say is infringing — including a URL or other location information detailed enough that we can find and review it.
- Provide your contact information. Include your full legal name, mailing address, telephone number, and email address so our designated agent can reach you about your complaint.
- Sign the notice and include the required statements. Your notice must state, under penalty of perjury, that the information is accurate, that you have a good-faith belief that the disputed use is not authorized by the copyright owner or law, and that you are the copyright owner or are authorized to act on the owner's behalf. Include your physical or electronic signature.
A Note on False Claims.
The DMCA imposes real consequences for misrepresenting a copyright complaint.
Under 17 U.S.C. § 512(f), anyone who knowingly materially misrepresents that material is infringing — or who knowingly misrepresents that material was removed by mistake — can be held liable for damages, including costs and attorneys' fees. Please don't file a notice you don't believe is accurate.
Filing a Counter-Notification.
If material you posted was removed because of a DMCA notice and you believe the removal was a mistake or misidentification, you may send a counter-notification. Your counter-notification must include all of the following:
- Sign your counter-notification. Include your physical or electronic signature.
- Identify the removed material. Describe the material that was removed (or disabled) and the location where it appeared before removal.
- Include a good-faith statement. State, under penalty of perjury, that you have a good-faith belief the material was removed or disabled as a result of mistake or misidentification.
- Provide your contact and consent. Include your name, address, and telephone number. State that you consent to the jurisdiction of the federal district court for the judicial district where your address is located — or, if your address is outside the U.S., for any judicial district where Angel Oaks may be found — and that you will accept service of process from the complainant who submitted the original notice or that person's agent.
What Happens Next.
When we receive a complete takedown notice, we'll act expeditiously to remove or disable access to the material in question and will notify the user who posted it. If we receive a valid counter-notification, we'll forward it to the original complainant. Per § 512(g), the material may be restored after 10–14 business days unless the complainant files suit and notifies us.
Notices that are incomplete or missing any of the elements above may delay our review or be rejected. If you're not sure your notice is complete, please consult an attorney before sending.
